The arbitration shall be conducted in English and shall take place in the United States. The arbitrator's award shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction. You and Costa Vida each agree to bear your own costs and attorneys' fees unless the arbitrator determines that your claim or our defense was frivolous or brought in bad faith.
11.3 Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND COSTA VIDA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
